Retail overtime is seasonal and real: holiday floor coverage, overnight resets, inventory counts, and truck days push full-time associates and keyholders past 40 hours in bursts. A full-timer at $19/hour who averages 10 overtime hours a week through a 12-week holiday stretch, plus scattered overtime the rest of the year, books $6,000–$9,000 in time-and-a-half wages — and the premium third deducts, up to $12,500 ($25,000 joint).
Retail's trap is the part-time portfolio. The FLSA counts hours per employer: 25 hours at one store plus 25 at another is a 50-hour week with zero required overtime, because neither employer crossed 40. Two part-time jobs at different locations of the same chain, though, are one employer — those hours combine, and overtime past 40 was owed and is deductible. Misclassified "assistant managers" doing associate work on salary are a separate, well-litigated wage issue; the deduction covers overtime premium actually paid.
Nondiscretionary extras — holiday incentive pay, attendance bonuses, spiffs — fold into the regular rate and nudge the deductible premium up. Warehouse-side retail employees (backroom, fulfillment) stack seasonal overtime the same way. Most retail claims are hundreds, not thousands — but the checkup takes a minute, the review is free, and the deduction repeats through 2028.
